Terms and Conditions - "ASUS Summer Cashback 2022"

This promotion - “ASUS Summer Cashback 2022-” will be run by ASUS Global Pte. Ltd. („ASUS“) and eligible partners. Customers accept the following terms („Terms and Conditions“) through their participation (Article 9: „Approval").

1. Legal terms

This information about refund and participation, combined with the ASUS Terms of Use Notice and the ASUS Privacy Policy, are the basis of these T&Cs. By participating in the promotion, the customer agrees to these T&Cs. ASUS is allowed to change these T&Cs with proper communication and announcement. Participants are obliged to accept these changes.

2. Promotion period and conditions of participation

The promotion begins at 00:01, Central European Time ("CET") on 18.06.2022 and ends at 23:59 CET on 12.08.2022 ("The promotional products (see the promotional products) must be purchased from an eligible partner (see the list of dealers below) within the „Promotional period“ and „Promotional zone“.

All purchases from participating partners in the „Promotional zone“ may be registered.

The participants' invoice/receipt must state the date of purchase and a valid billing address.

All valid promotional products (appendix "promotional products") must be purchased between 18.06.2022 and 12.08.2022

online or from a shop in the promotional zone (appendix "promotional zone").

3. Eligibility to participate

ASUS employees, employees of ASUS affiliates and/or partners, or cooperating companies and agencies, dealers, distributors and their employees/relatives are not entitled to participate in the promotion. In addition, corporate/commercial customers are not entitled to make claims under this promotion.

Participants must be residents of a country within the „Promotional zone“. Participation is free of charge.

4. Subject and rules of participation

By participating in this promotion, participants may receive a reward in the form of a monetary value in the currency of the applicable promotional region, as specified in the appendix.

The participant must also purchase a participating „promotional product“ during the „promotional period“ in the „promotional zone“ from one of the eligible partners in the participant's country of residence, and must submit a refund claim between 00:01 („CET“) on 02.06.2022 and 23:59 (“CET) on 26.08.2022 via the ASUS online form provided here:

The form must be completed fully and correctly, stating personal information, a valid commercial invoice (from which the promotional product(s) was/were purchased), the serial number of the ASUS product, and valid, detailed bank account information.

The personal information on the invoice (name, address) must match the refund information provided.

After reviewing and approving the application, ASUS will transfer the reward to the participant in the bank account designated by the customer. This process may take up to 90 working days. If the transfer attempt by ASUS or its designated agents fails, ASUS will not be required to make another attempt.

If a participant is not permitted to accept monetary transactions due to national or international laws, or to restrictions of their financial service providers or of the financial service provider of ASUS or its authorized representatives, this will result in immediate exclusion from the promotion. ASUS or its authorized representatives are not obliged to inform the customer. The money will be transferred only if the participant is also the owner of the bank account.

Invoices must comply with local legal requirements.

5. Promotional products

You must purchase a participating product/bundle listed in the „promotional products“ list. Products that are borrowed, rented, taken for trial or used are excluded from the promotion. A delivery note, receipt or order confirmation from a sales platform (bear this in mind when shopping online) is not sufficient proof of purchase.

Products that in any way infringe the intellectual property of ASUS or its affiliates are excluded from the promotion.

Each participant is entitled to claim only one (1) eligible product/bundle per product group during the promotional period. Any detected attempt at a double claim may disqualify all associated promotional claims.

If the participant returns their promotional product, the claim to the promotion will be cancelled. Claims already paid must be refunded to ASUS, plus an additional processing fee of 75,00 EUR. In addition, ASUS will take legal action against fraud or abuse.

The participant must make their purchase from a dealer in their country of residence.

6. Refund

The participant receives a confirmation email after submitting their application. If they successfully pass the validation process, the participant will receive the reward in the form of a monetary value. The validation process may take up to 20 working days.

If proof of purchase is missing or invalid, the customer will be notified by the email provided during the online registration process; accordingly, the customer will have seven (7) days to submit valid proof of purchase. If the organizer does not receive the above documentation within 7 days, the application will be rejected. It is the customer's responsibility to periodically check all email inboxes, including the SPAM folder, to ensure that all messages have been received correctly.

If the participant has not received the cashback within 90 days of registration, it is the participant's responsibility to contact the support team via [email protected] to initiate an investigation.

7. Early termination

ASUS reserves the right to interrupt or terminate the Promotion at any time, with appropriate communication and up to 10 days' notice, in the event of malfunctions, interruptions, fraud, viruses or similar incidents, and if the administration, security, fairness, integrity or procedure of the promotion is affected. There are no options or claims following early termination.

8. Data privacy

Participants agree that ASUS will retain their personal data, such as names, addresses and other information provided in the ASUS online form through this promotion and in accordance with the ASUS Privacy Policy: http://www.asus.com/Terms_of_Use_Notice_Privacy_Policy/Privacy_Policy

ASUS is committed to protecting and respecting your privacy. We strive to comply with all applicable laws concerning the protection of the privacy and security of personal information. 9. Approval

By submitting the registration form, the participant declares that they have read and agree to these terms of participation. ASUS reserves the right to change or amend these terms at any time. If the participant does not accept the change to the terms of participation, they may withdraw their registration by sending an email to [email protected]. Recourse to the courts is not permitted.

All claims for compensation against ASUS and its employees or indirect agents in connection with the promotion, regardless of the legal cause, are limited to cases of intent or gross negligence, to the extent permitted by law. The terms, as well as participation itself, are subject to local legislation. The place of jurisdiction is Amsterdam in the Netherlands.
