General terms and conditions for participation in the game „Nacon Giveaway“ on PC Build on Instagram

I. Organizer of the game

1. The organizer of the game is „PSBUILD” Ltd. with registered office and management address Sofia, ul. „Lyastovitsa“ 13, UIC 203464132, hereinafter referred to as the Organizer.

II. Responsibility

1. Participants in the Game are obliged to comply with these General terms and rules for participation in the Game („General terms“). The General terms are available for the entire duration of the Game on the PC Build website: http://bit.ly/nacongiveaway_usloviya
    
2. „PSBUILD” Ltd. reserves the right to change or supplement the General terms of the Game at its discretion, with changes taking effect after their publication on the PC Build website: http://bit.ly/nacongiveaway_usloviya and on the PC Build profile on Instagram: https://www.instagram.com/pcbuild.bg/
    
3. „PSBUILD” Ltd. is responsible for the organization and conduct of the Game in accordance with these General terms.
    
4. Each Participant in the Game is identified by their profile in the Instagram application, which they used to participate in the Game. The Organizer is not responsible and does not owe any compensation and/or penalty to a Participant in the Game and/or a third party whose Instagram profile was used unlawfully by a Participant in the Game and/or a third party, regardless of whether the respective third party and/or Participant in the Game has given consent for this.
    
5. The Organizer is not responsible in case of inability or difficulties for certain individuals to participate in the Game due to technical reasons or any other reasons beyond the control of the Organizer.

III. Duration of the Game

1. The Game takes place from 27.05.2021 to 07.06.2021 inclusive („Game Period“).
 

IV. Conditions for participation in the Game

1. The Game is held in accordance with these General terms.
    
2. By participating in the Game, each Participant expressly declares that they are familiar with the General terms, agree with them, and accept them.
    
3. Users of Instagram who are at least 18 years old, as well as individuals aged 13 to 18 with parental consent, who have their own „Instagram” profile („Participant/
   Participants“) have the right to participate in the Game and must simultaneously fulfill the following conditions:
   
   3.1. Follow the PC Build page on Instagram: https://www.instagram.com/pcbuild.bg/  
   3.2. Like the post announcing this game on the PC Build Instagram profile: https://www.instagram.com/p/CNujIriLx-q/
   3.3. Share the same post on their Story and tag PC Build with @pcbuild.bg on that story.

4. Participation in the game is not tied to the purchase of goods and/or services. By participating in the Game, Participants declare that they are at least 18 years old or have the consent of their parent or guardian to participate in the Game. Participants give their explicit consent for their usernames from the profiles with which they are registered in the Instagram application, as well as their first and last names, to be published on the PC Build profile in the Instagram application and to be included in an image that will be published as a Story on the above-mentioned PC Build Instagram page if they are determined to be winners in the Game.

5. Individuals who are employed or in any other relationship with „PSBUILD” Ltd. are not allowed to participate in the Game. Individuals working in stores or representatives of other companies providing goods and services on the territory of PC Build are also not allowed to participate in the Game.
 

V. Prize

1. By participating in the Game in accordance with these General terms, one of the Participants has the chance to win Nacon GC-200WL Wireless Gamepad - Black, which you can see here: http://bit.ly/giveaway_may
    
2. The prize will be awarded to the winning Participant in accordance with and upon fulfillment of the conditions in item IV - Conditions for participation in the Game.

VI. Determining the winning Participant and receiving the Prize

1. The name and/or username of the winning Participant from their Instagram profile will be announced within 7 working days after the end of the game period specified in point III.
    
2. The winning Participant will be notified of winning the Prize through a Story posted on the PCBuild.bg Instagram profile, as well as being informed through a direct message on Instagram. The winning participant must contact the organizer via direct message on the PC Build Instagram profile or by phone at 0888 852 000 within 3 calendar days after their announcement to clarify the details for receiving their prize.
    
3. The winning Participant must provide their full name, phone number, delivery address, and other details if necessary, within 3 calendar days for the purpose of delivering their prize.
    

VII. Mechanism for determining the winner
 

1. The winning participant will be selected randomly.
    

VIII. Procedure for claiming, verifying, and receiving the Prize

1. The prize will be sent and delivered to an address specified by the winning participant, or to the PC Build store in Sofia, 37 Maragidik St., from where they can collect the prize, within two weeks from the date of announcement of the winning Participant, according to point VI.2 above. The winning Participant receives the Prize upon signing a receipt protocol, under the following conditions:

       2. The Participant must claim the Prize within the period described in these General Terms;

       3. The Participant must provide a valid identification document, the details of which must match the details provided by the winning Participant according to point VI.3 above (if such have been requested). In case the winning Participant cannot collect the Prize in person, it may be collected by a person expressly authorized by them for this purpose with a notarized power of attorney.

      4. In case the winning Participant does not appear to collect their Prize within the period specified in point VIII above, as well as in case of non-compliance with the conditions in points IV, IV or VI above, the Participant has no right to receive the Prize. In this case, the Organizer bears no responsibility for the non-provision of the Prize, nor for compensating the withdrawn Participant who has not received their Prize, due to the application of this point VIII.2. The consequences specified in this point VIII.2 also apply in case the Participant is contacted by „PCBUILD“ Ltd and/or a person authorized by them on their registered Instagram profile, but cannot be found and/or does not provide the requested details within the period specified in point VI. The Organizer is not responsible if the Participant has provided invalid, incomplete, or inaccurate contact details. In these cases, a new winning Participant may be drawn in accordance with these General Terms.

IX. Exclusion from the Game

1. Until the Prize is provided, Participants who:
   1.1. have violated these General Terms in any way; and/or;
   1.2. participate with a false identity or on behalf of third parties, with or without their explicit knowledge;
   1.3. publish offensive or obscene content in a comment under the game photo will be excluded from the Game without notice.

X. Data Protection

1. In order to administer the Game, „PCBUILD” Ltd UIC 203464132, as the administrator of personal data, may process personal data of the participants, names and email addresses of the Participants according to their Instagram profile, with which Participants are identified according to II above; names, phone numbers, and emails of the winning Participants, provided according to point VI above solely for the purposes of the game and providing the prize to the winning participant.
 

XI. Termination of the Game

1. The Organizer has the right to terminate the Game at any time without prior notice in case of:
   1.1. occurrence of technical reasons that hinder the conduct of the Game;
   1.2. changes in the applicable legislation;
   1.3. orders from competent state authorities;
   1.4. occurrence of force majeure; or
   1.5. other objective reasons leading to the Organizer's inability to ensure the overall organization and uninterrupted conduct of the Game.
    
2. In case the termination of the Game is directly or indirectly due to the actions of a Participant/Participants in the Game, the Organizer has the right to take all necessary legal and factual actions to recover the damages caused.

XII. Other
 

Any questions regarding the conduct and organization of the Game should be sent in writing to the following address: [email protected]. Complaints and reports related to the Game can also be submitted to the same email address. Anonymous complaints and reports will not be considered by the Organizer.
 

XIII. Judicial Disputes
 

1. In case any of the provisions of these General Terms is or becomes invalid or for any reason does not produce its effect, this shall not affect the validity and effect of the remaining provisions of these General Terms.
    
2. The provisions of these General Terms are governed and interpreted in accordance with the laws of the Republic of Bulgaria.
    
3. Disputes between the Organizer of the Game and participants in the same shall be resolved by mutual agreement. In case of inability to reach such an agreement, the dispute shall be resolved by the competent courts in the Republic of Bulgaria.
